Court dismisses Railways' appeal, emphasizes welfare statutes in compensation claims


In a significant judgment, the Gujarat High Court has upheld the compensation awarded to Mandabai, the mother of a deceased passenger who fell from a train, dismissing the appeal filed by the Union of India. The case, Union Of India v. Mandabai, centered around the tragic incident that occurred on April 17, 2017, when Prakash, traveling from Mumbai to Ahmedabad, fell from a passenger train and died on the spot.


The Railway Claims Tribunal had initially awarded a compensation of Rs. 8 lakhs with 9% interest from the date of the incident till realization. The Railways contested this decision, arguing that Prakash was not a bona fide passenger since no ticket was found on him, suggesting possibilities of suicide or negligence on his part. However, the Gujarat High Court, presided by Mr. J.C. Doshi, J., dismissed these claims, emphasizing that the mere absence of a ticket does not negate the deceased's status as a bona fide passenger.


The judgment underscored the principle that procedural irregularities should not defeat legitimate claims under welfare statutes. The court noted the failure of the railway authorities to complete the investigation within the stipulated 60-day period as required by Rule 7.2 of the Railways Passengers (Manner of Investigation of Untoward Incidents) Rules, 2003. Consequently, the investigation report was disregarded, affirming the claimant's entitlement to compensation.


The court further cited precedents from the Supreme Court, including judgments in the cases of Kalandi Charan Sahoo and Shrikumar Gupta, which reinforced the notion that compensation claims should not be hindered by hyper-technical approaches. The High Court reiterated that no sane person would attempt to deboard or alight from a running train, rejecting the Railways' argument that the deceased's actions amounted to negligence or suicide.


The judgment is a reaffirmation of the welfare-oriented approach in adjudicating compensation claims under the Railways Act, 1989, advocating for relief to victims and their families, and dismissing procedural imperfections in investigations as grounds for denial of claims. The decision directs the Tribunal to disburse the remaining compensation to Mandabai, ensuring justice and support in her time of loss.
