Supreme Court Mandates Inclusion of Advocates in Bar Council Voter List, Court Orders Bar Council to Provide Reasons for Exclusion and Opportunity to Rectify to Ensure Fair Election Process
In a landmark judgment, the Supreme Court of India has directed the Bar Council of India to ensure that all advocates excluded from the voters' list for the upcoming M.P. State Bar Council elections are given individual reasons for their exclusion. The Court further mandated that these advocates must be provided an opportunity to rectify any deficiencies to secure their inclusion in the revised voters' list.
The case was brought forward by the District Bar Association, Katni, which, along with one of its members, filed a writ petition under Article 32 of the Constitution of India. The petitioners sought directives to include the names of advocates who were initially excluded from the electoral rolls for the forthcoming elections.
According to the records, 235 members were initially excluded from the list, and after submitting a representation, 183 names were re-included. However, 52 advocates still remained excluded, prompting the legal challenge.
During the proceedings, Senior Counsel Guru Krishna Kumar and Advocate Harsh Parashar represented the Bar Council of India and the Returning Officer of the State Bar Council, M.P., respectively. A note from Justice Sushil Kumar Palo, the Returning Officer, specified the requirements for an advocate to be included in the voters' list, which include depositing the requisite Advocates Welfare Fund, complying with the Certificate and Place of Practice Rule, submitting a Declaration Form, and passing the All India Bar Examination.
The Court noted that the reasons for exclusion had not been individually communicated to the affected advocates. Consequently, it permitted the excluded advocates to address these deficiencies within two days. The High Powered Election Committee in Jabalpur was instructed to reconsider their claims and update the voters' list by May 9, 2026.
The revised list will enable the included advocates to exercise their voting rights in the elections scheduled for May 12, 2026. The writ petition and all related interlocutory applications were disposed of in line with these directives.
