Allahabad HC seeks detailed records in case related to framing of UP X-ray technicians service rules

Lucknow, May 8 The Allahabad High Court on Friday sought detailed records related to the framing of the Uttar Pradesh X-Ray Technicians Service Rules, 2024, and directed a senior personnel department officer to appear before it with the relevant documents on May 13.


A Lucknow bench of Justice Karunesh Singh Pawar passed the order while hearing a petition filed by Diwakar Singh.


During the proceedings, Sunil Kumar Verma, joint director in the medical health and services department, appeared in person before the court.


According to the state counsel, records produced before the court showed that a decision had been taken on May 10, 2020 in compliance with a 2019 court order and that the rules were subsequently framed on that basis.


However, the court observed that the officer present was not fully aware of the process followed in framing the rules. It noted that neither the officer nor the state counsel could satisfactorily explain the procedure adopted while formulating the rules.


The bench granted two more days for production of the remaining records and directed that a responsible officer of the personnel department, not below the rank of special secretary, appear personally with the complete files on the next date of hearing.


The court also asked the parties to address arguments on the maintainability of the petition during the next hearing.
