Allahabad HC seeks reply on petition challenging order of ATS probe into madarsas

Prayagraj, Apr 23 The Allahabad High Court has asked the state counsel to address it on a writ petition challenging the order of the ATS inspector general directing inquiry by the Anti-Terrorism Squad (ATS) into madarsas in the state.


The order was passed by a two-judge bench comprising Justice Arindam Sinha and Justice Satya Veer Singh, which was hearing a petition filed by Teachers Association Madaris Arabia.


It was submitted before the court that petitioners are functioning under the Uttar Pradesh Board of Madarsa Education Act, 2004, and the Rules and Uttar Pradesh Non- Governmental Arabic and Persian Madarsa Recognition, Administration and Services Regulation, 2016.


The petitioner moved to court, challenging an order dated December 9, 2025, passed by the IG (ATS) directing an inquiry by Anti-Terrorism Squad (ATS).


The petitioner's counsel submitted, "order impugned is wholly unfounded and arbitrary act on part of the authority as will be evident from requisition dated 26th December, 2025, which does not have anything that can lead to suspicion of outside funding. The requisition does not have any question or reference to information that his clients are recipients of outside funding."


On other hand, on behalf of the state, it was submitted that the writ petition is premature. "It is only a direction for inquiry. If there is nothing to be found, that would be the report," it said.


After hearing counsels the court said, "State will be heard on basis for issuance of impugned order since petitioner challenges arbitrariness on assertion that it is functioning as per the Act and Regulations."


With the observation, the court posted the matter for hearing on May 4.
