Prayagraj, Apr 17 The Allahabad High Court has stayed the proposed demolition of 48 houses and shops in Dibiyapur area of Auraiya district, directing authorities to maintain status quo on the disputed properties.
A division bench comprising Justice Mahesh Chandra Tripathi and Justice Vivek Varma passed the order while fixing April 29 as the next date of hearing, asking the state government to file its counter affidavit within a week.
The court noted that an urgent mention was made before the Chief Justice on April 15 citing the imminent demolition of 48 residential and commercial establishments in Nahar Bazar area scheduled for 6 am on April 16.
Following this, the bench was constituted through an administrative order on the same day.
The writ petition, challenging the validity of an order dated September 30, 2025, sought directions to restrain authorities from evicting and dispossessing the petitioners from the land on which their houses and shops stand.
Counsel for the petitioners argued that despite submission of relevant documents, these were not considered while passing the impugned order.
He further submitted that any demolition would cause irreparable loss to the petitioners.
Opposing the plea, the state counsel contended that adequate opportunities had been provided to the petitioners, but they failed to appear during proceedings, leaving authorities with no option but to proceed as per law.
After hearing both sides, the court observed that a counter affidavit from the state government was necessary, and directed the matter be listed afresh before the appropriate bench on April 29.
