Disciplinary Action Ordered Against Police Officer for Disrespecting Court Orders
In a significant judgment, the Allahabad High Court has ordered a compensation of Rs. 5 lakhs to be paid to Anil Soni, who was illegally detained despite a stay order by the court. The court has also directed disciplinary action against the concerned police officer, S.H.O. Sanjay Kumar Mishra, for dereliction of duty and failure to comply with judicial orders.
The case stemmed from a habeas corpus petition filed by Anil Soni, who was arrested on April 4, 2026, despite an interim stay on his arrest issued by the High Court on April 1, 2026, in a related criminal writ petition. The arrest took place before the stay order was uploaded on the court's website, but the petitioner's counsel had duly informed the S.H.O. through various means, including a notary affidavit and direct communication.
The court, presided over by Justices Siddharth and Vinai Kumar Dwivedi, reprimanded the police authorities for their non-compliance and disrespect towards court orders, noting an alarming trend of such behavior. It emphasized the duty of legal counsel and officers to uphold the law and ensure the enforcement of judicial decisions.
Referring to Supreme Court precedents in Rudhal Shah v. State of Bihar and Nila Behara v. State of Orissa, the court asserted that monetary compensation is warranted for the violation of fundamental rights and illegal detention. The judgment further mandates the State Government to recover the compensation amount from the erring officer, S.H.O. Sanjay Kumar Mishra.
In addition to compensation, the court has ordered that disciplinary proceedings be initiated against the S.H.O. for failing to execute his official duties and for violating court orders. The Superintendent of Police, Siddharth Nagar, has been instructed to ensure compliance with the judgment and submit an affidavit by July 13, 2026.
