Court Allows Impleadment of Union Ministries; Sealed Cover Procedure Adopted for Writ Petition Documentation


In a significant move, the Allahabad High Court has directed the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) to verify allegations outlined in a writ petition filed by petitioner S. Vignesh Shishir. The directive mandates these agencies to file their responses within eight weeks, marking a crucial development in the case initiated under Article 226 of the Constitution of India.


The petitioner, appearing in person, sought the court's intervention to implead several Union ministries as necessary parties to the case. The court approved the application to implead the Union of India through its Secretary, Department of Personnel and Training, Department of Revenue, and the Ministry of Corporate Affairs as opposite parties. This move allows for a comprehensive examination of the allegations with the involvement of relevant government entities.


During the proceedings, counsel for the CBI, Anurag Kumar Singh, confirmed that the agency had received the petitioner's complaint and assured the court of a forthcoming response based on instructions from Praveen Kumar, Superintendent of Police, CBI. Similarly, Kuldeep Srivastava, representing the ED, informed the court that the allegations would be verified, with updates to follow.


The court has also initiated a sealed cover process for the documentation related to the writ petition. The paper-book and additional documents provided by the petitioner are to be securely stored with the Senior Registrar, to be opened at the next hearing date.


The petitioner has cited various case laws to support his prayers under the writ petition, which will be further scrutinized upon receipt of counter affidavits from the involved parties. The court has outlined that separate counter affidavits are expected from the CBI, ED, and other newly impleaded parties, ensuring a detailed examination of each entity's response to the allegations.


The matter has been scheduled for a subsequent hearing on July 20, 2026, where further developments and responses from the involved parties will be considered. The case underscores the judicial process's role in addressing significant allegations and ensuring accountability through thorough legal scrutiny.
