Delays in filling 50 vacant positions impacting the functioning of the Advocate General/State Law Officer Establishment


In a significant development, the Allahabad High Court has directed the U.P. Sub-ordinate Services Selection Commission to expedite the recruitment process for 50 vacant positions in the Advocate General/State Law Officer Establishment. The order comes in response to concerns over the delayed recruitment process affecting the functioning of the office and causing delays in justice delivery.


In the case of Subedar Yadav v. State of Uttar Pradesh, the court, comprising Justices Ajit Kumar and Devendra Singh-I, noted that the recruitment delay has led to inadequate assistance being provided to the courts, thereby impacting the timely administration of justice. The bench expressed serious concern over the current situation, emphasizing the necessity for the Commission to prioritize these vacancies above others.


The court has instructed the petitioner, Subedar Yadav, to include the U.P. Sub-ordinate Services Selection Commission, Lucknow, as a respondent in the case. The court also mandated that a notice be served to the Commission’s counsel within the next 24 hours to provide updates on the recruitment status.


During the proceedings, it was revealed that a requisition for the recruitment had been sent to the Commission, as confirmed by a personal affidavit from Mr. Manmeet Singh Suri, Special Secretary (Law) and Additional Legal Remembrancer, Government of U.P. However, the court was informed that details regarding the promotion of Level-VIII vacancies are still pending, with assurances that these would be clarified in due course.


The court has scheduled the next hearing for April 17, 2026, and has directed the State to file an affidavit clarifying the positions of Level-VIII vacancies available for promotion within the Advocate General/State Law Officer Establishment.


This directive underscores the court's commitment to ensuring that the Advocate General's office is adequately staffed to fulfill its responsibilities effectively, thereby facilitating timely justice delivery.
