In a landmark decision, the Allahabad High Court, presided over by Justice Prakash Padia, has ordered the expunction of adverse remarks made against Hemant Kumar Gupta, the Chairman of the District Consumer Dispute Redressal Commission, Shamli. The remarks were made by the State Consumer Disputes Redressal Commission, Lucknow, in two separate appeal cases, Appeal No. 1040 of 2023 and Appeal No. 318 of 2024. The judgment underscores the importance of providing judicial officers with an opportunity to explain their conduct before any adverse remarks affecting their career are made.


The petitioner, Hemant Kumar Gupta, challenged the adverse remarks which were allegedly passed without any notice or opportunity for him to defend himself. Gupta argued that such remarks could have a detrimental effect on his career, emphasizing that no adverse remarks should be made against a judicial officer without giving them a chance to explain.


Justice Padia, in his detailed judgment, referenced several precedents from the Supreme Court of India, reinforcing the principle that higher courts must exercise restraint and should not criticize subordinate judicial officers unless it is necessary for deciding a case. The court cited cases like "Pandit Ishwari Prasad Misra v. Mohammad Isa" and "Dr. Raghubir Saran v. State of Bihar," which highlight the need for judicial restraint and the importance of avoiding personal criticism unless absolutely necessary.


The judgment further stated that the appellate court must refrain from making personal remarks about subordinate judicial officers, and if such remarks are unjustified and made without notice or hearing, they must be expunged to secure justice and prevent harm to the affected individual. Justice Padia emphasized that the independence of the judiciary is linked to its credibility, and unwarranted comments could lead to erosion of this credibility.


The Allahabad High Court's decision to expunge the remarks is a significant affirmation of the judicial principles that protect the careers of judicial officers from unjustified criticism.
