The decision was handed down by Justice Ashutosh Srivastava on April 2, 2026, in response to a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023.


The case, which has garnered substantial attention, involves allegations that Jain was running an unauthorized embassy, complete with flags of various countries and diplomatic number plates on vehicles, without the requisite permission from the Ministry of External Affairs. The police, during a raid at the premises in Kavi Nagar, Ghaziabad, recovered various items, including documents, IDs, seals, and both Indian and foreign currencies.


Jain's legal team, led by Senior Counsel Manish Tiwary, argued that the items seized were novelty souvenirs from recognized micronations, meant for identification and ceremonial purposes rather than fraudulent activities. They contended that there was no substantive evidence of fraud or financial impropriety on Jain's part, and that the investigation had concluded with the filing of a charge sheet.


The prosecution, represented by AGA Pankaj Saxena, opposed the bail application, citing incriminating evidence against Jain. However, they could not counter the defense's arguments regarding the completion of the investigation and the lack of need for further custodial interrogation.


In his order, Justice Srivastava noted that the investigation was complete and a charge sheet had been filed. He emphasized the absence of any further requirement for custodial interrogation and the assurance from Jain to cooperate with the trial proceedings. The court granted bail with specific conditions, including a personal bond, reliable sureties, and an undertaking from Jain not to tamper with evidence or engage in criminal activities.


The decision underscores the court's balanced approach in ensuring individual liberty while safeguarding the interests of justice. Jain's release is contingent upon compliance with the court's conditions, with any breach potentially leading to the cancellation of bail.
