In a significant ruling, the Allahabad High Court has emphasized the critical role of teachers in ensuring quality education, directing the State of Uttar Pradesh to implement stringent measures for teachers' attendance in primary schools. The judgment was delivered by Justice Prakash Padia while disposing of writ petitions filed by Indra Devi and others challenging their suspension due to non-attendance during inspections.


The court observed that consistent teacher attendance is indispensable to fulfill the objectives of the Right of Children to Free and Compulsory Education Act, 2009, and to uphold the fundamental right to education as enshrined in Article 21-A of the Constitution of India. The absence of teachers, the court noted, undermines the Act’s purpose and deprives children of their educational rights.


The judgment highlights the pivotal role teachers play not only in imparting knowledge but also in shaping the moral, emotional, and social growth of students. Citing various Supreme Court rulings and ancient Indian scriptures, the court reiterated the high ethical standards expected of teachers, describing them as essential members of society who should set exemplary conduct.


In addressing the specific cases, the court refrained from interfering with the suspension orders but directed the disciplinary authorities to expedite the proceedings against the suspended teachers, concluding them within two months. Furthermore, a mandamus was issued to the Special Secretary, Basic Education, U.P., to formulate a policy ensuring the timely attendance of teachers, with a mandate to implement digital attendance systems within three months.


The court acknowledged the ongoing efforts by the state to digitize attendance and improve educational quality through district and block-level task forces. However, it stressed the need for concrete actions to translate these policies into practice effectively.


This ruling serves as a reminder of the profound respect accorded to teachers in Indian culture, as reflected in both historical texts and judicial pronouncements, underscoring their irreplaceable role in nation-building and societal development.
