Detention Beyond Sentence Period Deemed Unconstitutional Under Article 21
In a pivotal judgment, the Allahabad High Court has ordered the immediate release of Vinod Kumar, who was unlawfully detained even after serving his full ten-year prison sentence. The judgment, delivered by Justice Sameer Jain, criticized the authorities for failing to release Kumar despite a stay on the fine imposed by the High Court on September 24, 2025. The court was informed that Kumar had completed his sentence but remained in custody because he had not paid the fine of ?27 lakhs imposed alongside his sentence.
The counsel for Kumar, Ajay Kumar Pathak, along with senior advocates Govind Saran Hajela and Gyan Prakash, argued that the continued detention was unlawful, especially after the court had stayed the fine. The court concurred, noting that the authorities had a duty to release him immediately once the fine was stayed, provided he was not required in any other legal matter.
Justice Jain emphasized that detaining an individual beyond the term of their sentence without lawful justification infringes upon their right to life and personal liberty. This decision highlights the judiciary's commitment to uphold constitutional rights and serves as a stern reminder to authorities about the legal implications of unauthorized detention.
The High Court directed that Kumar be released on a personal bond immediately, reinforcing the principle that no individual should be deprived of their liberty without due process.
