The Division Bench, comprising Justices Atul Sreedharan and Siddharth Nandan, highlighted the State's constitutional obligation to safeguard the right to life and issued directives to prevent such incidents in the future. The court ordered the formation of a committee to recommend infrastructural and procedural improvements, ensuring that similar lapses do not recur. The committee will operate under the Principal of the concerned Medical College, collecting data and recommending necessary reforms within five weeks.


The case involved the tragic demise of the petitioner's mother, who was administered the wrong blood group—AB+ instead of her actual O+ - resulting in fatal post-operative complications. Acknowledging the negligence, the court noted that the deceased’s treatment was primarily aimed at countering the ill effects of the incorrect transfusion. The Additional Advocate General conceded the mistake, underscoring the need for systemic changes.


The court also addressed the issue of compensation for the victim's family, seeking assistance from both parties to evaluate factors and precedents relevant to granting compensation. The Principal of the Medical College is required to submit a personal affidavit with a comprehensive report, detailing the proposed infrastructural and procedural improvements. Additionally, the court expects a proposal on the quantum of compensation, with the next hearing scheduled for March 23, 2026.


The judgment underscores the critical need for accountability and systemic reform in medical institutions to uphold the fundamental right to life, ensuring that such grave lapses in medical care do not occur again.
