In a pivotal judgment, the Allahabad High Court has reversed a previous decision by a single judge, affirming the right of Smt. Madhuri Tiwari, the widow of a deceased government employee, to claim terminal benefits, including the family pension. The division bench, comprising Justices Saumitra Dayal Singh and Indrajeet Shukla, ruled that the widow has the locus standi to seek these entitlements as the legal representative of her late husband, Trilok Nath Tiwari, an Assistant Teacher at D.A.V. Inter College, Prayagraj.
The court was hearing an appeal against the order dated October 10, 2025, which dismissed Madhuri Tiwari's writ petition on the grounds that she had no standing to claim benefits posthumously for her husband. The single judge had argued that since the deceased had not pursued the regularization of his service during his lifetime, the widow could not claim these benefits after his death.
However, the division bench found this reasoning flawed. It emphasized that the widow, as the legal heir, is entitled to pursue terminal dues on behalf of her deceased husband, particularly when the claim is based on an existing resolution by the Regional Regularization Committee. This resolution, dated January 21, 2019, corrected the date of regularization of the deceased employee, thereby impacting the calculation of his retirement benefits.
The High Court also addressed concerns of delay in filing the claim, noting that there was no unjustified delay on the part of the petitioner. The resolution had been acknowledged and acted upon during the lifetime of the deceased, with communications issued by the Finance & Accounts Officer and the District Inspector of Schools, Prayagraj. The bench observed that the claim for pecuniary benefits was under active consideration and not barred by any statutory limitation, as alleged.
Consequently, the court set aside the earlier judgment and directed the respondent authorities to implement the decision of the Regional Regularization Committee expeditiously. The authorities have been instructed to revise the service records, recalculate the pension and retirement benefits, and release any arrears along with interest to the petitioner within a month.
The decision is a significant affirmation of the rights of widows to claim due entitlements of their deceased spouses, especially in cases where procedural resolutions have been previously established but not acted upon due to administrative delays.
