Fiduciary relationship exception saves plaintiff's suit from summary rejection, court mandates fresh trial.


In a significant ruling, the Allahabad High Court has set aside a trial court's decision that rejected a suit concerning a property dispute under the Benami Transactions (Prohibition) Act, 1988. The plaintiff, Sunil Kumar Dublish, had filed a suit claiming sole ownership of a property in Meerut, alleging it was purchased in his mother's name using funds from a Hindu Undivided Family (HUF). The trial court had dismissed the suit, citing it as barred under Section 4(1) of the Act.


However, Justice Sandeep Jain of the Allahabad High Court found that the trial court committed a material illegality by not considering the exception of a fiduciary relationship under Section 4(3)(b) of the Act. The plaintiff argued that his mother acted as a benami holder due to the fiduciary relationship, which the trial court failed to evaluate adequately.


The High Court emphasized that at the stage of deciding an application under Order 7, Rule 11 of the CPC, only the plaint's averments and accompanying documents should be considered, not the merits of the case. The court clarified that whether a property is benami involves disputed questions of fact, which should be decided based on evidence, not at the initial stage.


Consequently, the High Court restored the original suit, directing the trial court to resolve the matter within six months. The trial court is instructed to proceed without unnecessary delays and is free to form its conclusions based on the evidence presented during the trial.


This judgment underscores the importance of examining fiduciary relationships and other exceptions in benami property disputes, highlighting that summary rejections at the preliminary stage are inappropriate without a comprehensive analysis of all aspects.
