The High Court ruled that the lower court's decision to dismiss the application was arbitrary and illegal, emphasizing that the income tax returns are crucial to ascertain the true income of the husband, which directly impacts the maintenance proceedings. The High Court directed the trial court to reconsider the application while adhering to the guidelines laid down by the Supreme Court in the landmark case of Rajnesh v. Neha.


The Supreme Court's guidelines mandate the disclosure of assets and liabilities in all maintenance proceedings, and if necessary, allow the court to order the production of relevant financial documents. The Allahabad High Court noted that the income of one spouse is often not within the knowledge of the other, making such disclosures essential for fair maintenance adjudication.


The case stems from a series of allegations by Mariya Zafar, who claims she was subjected to severe harassment, dowry demands, and physical abuse, resulting in a miscarriage. Despite her qualifications as a B-Tech Gold Medalist, Mariya was forced to abandon her career aspirations and endure domestic exploitation. Her attempts to secure maintenance through legal channels were initially thwarted by her husband's alleged misrepresentation of his financial status.


During the proceedings, the High Court obtained the income tax returns of Mohd. Saleem, which revealed his profession as an architect with a substantial annual income, contrary to his claims of being a laborer. This discrepancy was pivotal in the High Court's decision to set aside the trial court's order.


The Allahabad High Court has now mandated the trial court to reevaluate the maintenance application, ensuring compliance with the Supreme Court's directives, and has granted Mariya access to her husband's income tax returns for the relevant assessment years.


This judgment underscores the judiciary's commitment to ensuring transparency and fairness in matrimonial disputes, particularly in cases involving allegations of domestic violence and dowry harassment.
