Court Grants Discharge to Female Accused in House Burglary While Upholding Charges Against Others
In a significant ruling, the Allahabad High Court's Lucknow Bench, presided over by Justice Subhash Vidyarthi, has partially allowed a discharge application in a controversial burglary case from Sultanpur. The case, which revolves around alleged theft and house-breaking, saw the petitioners challenging the decisions of the lower courts to proceed with charges against them.
The proceedings arose from an incident on December 26, 2018, where the complainant accused multiple individuals of breaking into his house and stealing various goods. Despite the initial FIR naming only four individuals, the investigation led to a charge-sheet against nine, including several women.
The petitioners filed for discharge under Section 227 of the Criminal Procedure Code, arguing that the trial and revisional courts had not adequately evaluated the evidence, particularly noting that some accused were not mentioned in the initial complaint or key witness statements.
Justice Vidyarthi emphasized the necessity for courts to critically assess prosecution materials, rather than acting as mere facilitators. The judgment underscored that the failure to initially name certain accused persons and the lack of recovery from them raised serious doubts about their involvement.
Consequently, the court granted discharge to petitioners Kailashpati, Renu, Sitau Devi, and Urmila, who were not named in the initial complaint and had no recoveries made from them. However, the court upheld the charges against the primary accused, including those from whom stolen items were allegedly recovered.
This judgment reiterates the judiciary's duty to ensure that charges are based on substantial suspicion and evidence, rather than conjecture, especially in cases intertwined with civil disputes.
