In a significant judgment, the Allahabad High Court has set aside the dismissal of three bank employees accused of obtaining their positions through fraudulent means. However, the court noted that the handwriting expert was neither examined nor cross-examined during the disciplinary proceedings, undermining the fairness of the process.


Justice Chauhan highlighted the importance of cross-examination as a fundamental component of natural justice, emphasizing that the employees were denied a fair opportunity to challenge the handwriting expert's findings. The court also pointed out that the disciplinary authority failed to independently consider other crucial evidence, such as thumb impressions and photographs verified by the examination invigilator, which could have corroborated the employees' presence during the examination.


The court criticized the disciplinary proceedings for relying solely on the handwriting expert's opinion without exploring other modes of identification. It underscored that the report, not being subjected to cross-examination, remained a weak piece of evidence, especially when other identification methods like photographs and thumb impressions were available but ignored.


The judgment further called for disciplinary proceedings to be conducted with fairness, justice, and reasonability, ensuring that all relevant evidence is considered. It granted SBI the liberty to initiate fresh disciplinary proceedings, provided they adhere to principles of natural justice, and allowed the bank to place the employees under suspension after reinstatement, pending a new inquiry.


This ruling serves as a reminder to institutions about the critical importance of following due process in disciplinary actions, ensuring that all parties are given a fair opportunity to present and challenge evidence.
