In a significant ruling, the Allahabad High Court has quashed a detention order under the National Security Act (NSA) against Isham @ Isam, who was detained for alleged cow slaughtering. The court found that the act took place within the confines of a house and did not disturb public order or communal harmony, thereby rendering the detention order unsustainable in law.


The detention order dated May 26, 2025, issued by the District Magistrate of Shamli, and the subsequent confirmation order by the Uttar Pradesh Government were both annulled by the bench comprising Justice Rajeev Misra and Justice Dr. Ajay Kumar-II. The judges emphasized that while cow slaughtering is prohibited in Uttar Pradesh, the mere occurrence of such an act within a private residence, away from public view, does not constitute a breach of public order as required under the NSA.


The case arose from an incident on April 23, 2025, when the police allegedly discovered evidence of cow slaughtering inside a house in Shamli. The petitioner was subsequently detained under Section 3(2) of the NSA based on reports suggesting that the act had disturbed public order and communal harmony. However, the court found no evidence of any public disturbance or communal tension resulting from the incident.


During the proceedings, the petitioner's counsel cited past judgments, including Faiyyaz Quraishi v. Union of India, which established that clandestine acts within private premises do not automatically translate to public disorder unless they are in public view or cause visible communal unrest.


The court's decision reflects a careful interpretation of what constitutes a public order breach under the NSA. The bench highlighted that legal provisions must be applied judiciously, ensuring that actions taken under the NSA are justified by actual threats to public peace and not merely perceived risks based on private acts.


As a result of the judgment, the petitioner, Isham @ Isam, is to be released immediately, provided there are no other pending charges against him. This case underscores the judiciary's role in safeguarding individual rights against potential overreach in the application of security laws.
