The court found that the delay in communication from the District Basic Shiksha Adhikari (DBSA) triggered a provision of deemed approval under the Uttar Pradesh Recognized Basic Schools (Junior High School) Rules, 1984.


The case centered on the appointment process for the post of Clerk, which was challenged when the DBSA, Gorakhpur, disapproved the selection, citing procedural irregularities. The selection was initially conducted on May 25, 2017, and the relevant documents were submitted to the DBSA on September 4, 2017. However, the disapproval order, dated September 28, 2017, was communicated to the school only on October 7, 2017, exceeding the 30-day period stipulated for decision-making under Rule 15(5)(iii) of the 1984 Rules.


Justice Manju Rani Chauhan, presiding over the case, emphasized that the statutory provision clearly mandates deemed approval if the DBSA fails to communicate a decision within the prescribed timeframe. Despite the DBSA's internal marking of the case on September 6, 2017, the court concluded that the subsequent communication delay rendered the disapproval invalid.


The court also addressed objections regarding the legitimacy of the selection committee, which included a nominee from the DBSA's office. Although the DBSA contended that the nominee's participation was unauthorized, the court dismissed this as a hypertechnical objection, noting that the nominee's involvement lent legitimacy to the process.


Additionally, the court found that delays in forwarding the selection documents, attributed to flood conditions in Gorakhpur, did not vitiate the selection process. The court reaffirmed the principle that procedural timelines are typically directory unless explicitly stated otherwise, and no prejudice was shown to have resulted from the delay.


In conclusion, the court quashed the DBSA's disapproval order, directing that all consequential benefits of the appointment follow. The ruling reinforces the importance of adhering to statutory timelines and underscores the protection afforded to minority institutions under the law.
