The case, Yuvaraj v. State of U.P., centered around the custody of two young children, Yuvaraj and Ayushman, aged 6 and 4, who were reportedly in the care of the respondent’s sister and brother-in-law against the wishes of their mother.


The original petition, Habeas Corpus Writ Petition No. 670 of 2025, was dismissed by a Single Judge, who upheld the father's right to transfer the custody of his children. The judgment had sparked controversy by asserting that a father, as the natural guardian, could transfer de facto custody without needing to consider the welfare of the children or the objections of the other parent.


The appellate court found this reasoning to be flawed, emphasizing that the welfare of the children is paramount and must be the primary consideration in custody matters. The Bench highlighted that any transfer of custody should be subject to judicial scrutiny, especially when contested by the other parent.


The appeal was allowed, and the previous order dated April 3, 2026, was set aside. The case has been remanded back to the Single Judge for a fresh hearing, scheduled for May 4, 2026, where the petition will be reconsidered in light of the children's best interests.


The decision underscores the judiciary's commitment to ensuring that the welfare of minors is not compromised by custodial arrangements that may be convenient for one parent but detrimental to the children’s well-being.
