However, the bank rejected the application in 2023 without assigning specific reasons, leading to the legal challenge.


The court criticized the bank's lack of reasoning in its rejection order and highlighted the broader purpose of the Compassionate Appointment Rules, 1974. Justice Singh noted that these rules are designed to alleviate financial distress for families of deceased employees, underscoring the need for authorities to act with sympathy and understanding.


The judgment referenced the Supreme Court's decision in Mohinder Singh Gill v. Chief Election Commissioner, reinforcing the principle that administrative decisions must be transparent and reasoned. The court observed that PNB had failed to apply its mind in making the rejection, as evidenced by the absence of detailed deliberation.


Justice Singh also pointed out the cultural and constitutional values enshrined in Article 51A(g) of the Indian Constitution, urging decision-makers to consider the emotional and financial plight of bereaved families. The court's directive mandates PNB to reconsider the application within eight weeks, providing a fresh opportunity for Jaiswal's claim to be evaluated in light of these compassionate principles.
