Rameshwar Singh's appeal dismissed; Court affirms wife's testimony as reliable evidence in domestic violence and dowry demand case


In a significant judgment, the Allahabad High Court upheld the conviction of Rameshwar Singh in an attempted murder case involving domestic violence and dowry demands. The case, presided over by Justice Abdul Shahid, rejected Singh's appeal against the conviction and sentence handed down by the VI Additional District and Sessions Judge, Mainpuri, in 1985. 


The case revolved around the appellant, Rameshwar Singh, who was accused of shooting his wife, Vimla Devi, during a domestic dispute. The prosecution's case was based heavily on the testimony of the injured wife, who served as a crucial witness. The court found her testimony credible and corroborated by circumstantial evidence, despite the defense's claims of inconsistencies and lack of forensic evidence.


The appellant's defense argued that the injuries were inflicted by unknown miscreants and not by Singh. However, the court noted that the injured witness's testimony was consistent and reliable, and it was improbable for the victim to misidentify her own husband as the assailant. The court emphasized the importance of the quality of witness testimony over the quantity, affirming the conviction under Section 307 of the Indian Penal Code for attempted murder.


The judgment highlighted the strained marital relations and the accused's demands for dowry, which were corroborated by the testimony of the injured witness and other circumstantial evidence. Despite the defense's attempt to downplay the severity of the injuries and argue for a lesser charge, the court maintained that the evidence clearly demonstrated the accused's intent to cause death.


The court dismissed the appeal and ordered the appellant to surrender to complete his sentence, emphasizing the need for justice in cases of domestic violence and dowry-related crimes.
