The Allahabad High Court has upheld the disciplinary action taken against Mahaveer Sagar, a clerk in the District Judiciary, Rampur, for the misplacement of a judicial file, dismissing his petition for relief. The court, presided over by Justice Anish Kumar Gupta, found no merit in interfering with the disciplinary authority's decision to withhold four increments of the petitioner with cumulative effect.


The case arose when the Chief Judicial Magistrate of Rampur reported the absence of a crucial file pertaining to Complaint Case No. 240 of 2005. Despite several opportunities to locate the file, it remained untraceable. Subsequent investigations identified Sagar as the responsible clerk at the time of the file's disappearance, leading to disciplinary proceedings against him under Rule-3 of the U.P. Government Servant Conduct Rules, 1956.


The petitioner challenged the orders dated 23.10.2007 and 11.03.2011, issued by the disciplinary and appellate authorities respectively, arguing procedural lapses and questioning the assignment of liability. However, the court noted that Sagar failed to demonstrate any procedural defects during the disciplinary process. The court also emphasized the limited scope of judicial review in such cases, underscoring that the appropriate procedures had been followed and the punishment was proportionate to the misconduct.


Justice Gupta highlighted the seriousness of the allegations, noting that the loss of a judicial file critically impacts the administration of justice. The court concluded that no procedural unfairness occurred, and the punishment awarded was appropriate given the circumstances.


The dismissal of this petition serves as a reminder of the stringent accountability measures within the judiciary to maintain the integrity of judicial processes and records.
