In a landmark decision, the Allahabad High Court has directed the State of Uttar Pradesh to provide ex gratia compensation to the petitioner, Kishori Lal, whose wife died due to a snake bite in 2019. The case, titled "Kishori Lal v. State of U.P.," highlights the court's emphasis on the effective implementation of welfare schemes and the retrospective nature of clarificatory notifications.


The petitioner sought relief under a government notification dated August 2, 2018, which classified snake bites as a state disaster, entitling victims' families to compensation. However, his claim was initially rejected due to inconclusive postmortem findings and the absence of a viscera report. A subsequent government order on July 8, 2021, clarified that a viscera report was not necessary for such claims, emphasizing the need for timely relief.


The bench, comprising Justices Ajit Kumar and Swarupama Chaturvedi, ruled that clarificatory notifications are retrospective and should be read harmoniously with the original notification to fulfill the welfare scheme's objectives. The court criticized the authorities for rejecting claims on hyper-technical grounds, contrary to the scheme's purpose.


The judgment underscored the reliability of contemporaneous records, such as the General Diary entry, inquest report, and witness statements, which consistently supported the snake bite as the cause of death. The court applied the principle of contemporanea expositio, affirming that these records carried significant weight in the absence of conclusive medical evidence.


The court's decision aligns with the Supreme Court's stance in previous cases, recognizing that clarificatory or declaratory statutes operate retrospectively. It emphasized that beneficial schemes should be construed liberally to advance their intended objective, avoiding undue technicality.


The Allahabad High Court's ruling mandates the District Magistrate of Jalaun to reassess the petitioner's claim and provide compensation within six weeks, reinforcing the state's commitment to timely support for families affected by state-specific disasters.
