Court Affirms Discretionary Nature of Section 143-A Under NI Act, Orders 20% Compensation

Subsequently, the complainant sought interim relief under Section 143-A, which allows for interim compensation up to 20% of the cheque amount.
The trial court granted this relief, directing Yadav to pay Rs. 2,00,000 as interim compensation. Yadav contested this, arguing that the transaction was based on unverified cash payments without documentary proof of a legally enforceable debt. However, the High Court, citing the statutory presumptions under the NI Act and the discretionary nature of Section 143-A, dismissed Yadav's application, affirming the trial court's decision.
The judgment emphasized that while courts are not required to conduct a detailed appreciation of evidence at the interim stage, they must consider the prima facie merits of the complaint and the defense. The court also noted that the admitted signatures on the cheques and the accused's financial distress did not negate the complainant's prima facie case.
