Court Rules Death in Routine Duty Road Accident Not Eligible for Pension Under Extraordinary Circumstances


In a significant judgment, the Allahabad High Court at Lucknow, presided over by Justice Vikas Budhwar, upheld the State Government's decision to reject the claim for extraordinary pension by Smt. Shushila Shukla, whose late husband, a follower in the State Civil Police, died in a road accident while on duty. The court ruled that the circumstances of his death did not fall within the extraordinary provisions defined under the Uttar Pradesh Police (Extraordinary Pension) Rules, 1961.


The petitioner, Smt. Shushila Shukla, sought extraordinary pension benefits following the tragic demise of her husband, who was en route to prepare meals for additional police forces deployed for election duties. On October 2, 1999, he was fatally injured in a road accident involving a Maruti Car. Despite the initiation of criminal proceedings against the vehicle driver, her claim for extraordinary pension was rejected by the state authorities in 2002.


The pivotal point of contention was whether the death circumstances warranted pension under Rule 3 of the Extraordinary Pension Rules, which enumerates specific scenarios such as death due to attacks by dacoits, extremists, or while performing duties during natural disasters and man-made calamities. Justice Budhwar highlighted that Rule 5 explicitly prohibits awards for deaths outside these enumerated circumstances.


The court also addressed the potential applicability of Article 226 of the Constitution of India, which allows for judicial review of administrative decisions. However, Justice Budhwar found no merit in interfering with the State Government's decision, considering the death did not meet the extraordinary conditions outlined in the 1961 Rules. The court observed that remanding the matter back to authorities would be futile and left it open for the petitioner to seek remedies under the Motor Vehicles Act against the vehicle owner or driver.


This judgment reinforces the strict interpretation of statutory provisions concerning extraordinary pension claims, emphasizing the necessity for death circumstances to align explicitly with predefined extraordinary situations. The court's decision underscores the importance of statutory clarity and the constraints of judicial intervention in administrative matters.


Bottom line:-

Extraordinary pension under Uttar Pradesh Police (Extraordinary Pension) Rules, 1961 cannot be granted if the death does not fall within the specific circumstances enumerated under Rule 3, and Rule 5 explicitly bars awards for deaths outside these circumstances.
