Valuation for Court Fee Dictates Jurisdiction; Appeal Redirected to District Court


In a significant ruling, the Andhra Pradesh High Court dismissed the Civil Miscellaneous Appeal No. 609 of 2025, filed by Valladasi Sri Mounika @ Sirisha, on the grounds of improper jurisdictional valuation. The Division Bench, comprising Justices Sri Ravi Nath Tilhari and Sri Maheswara Rao Kuncheam, emphasized the importance of correctly determining jurisdiction based on court fee valuation as per the Andhra Pradesh Court Fees and Suits Valuation Act, 1956.


The case originated from a suit for declaration and consequential injunction filed by Anumula Usha Lakshmi and others in the Court of the Civil Judge (Senior Division), Pithapuram, which valued the relief at Rs. 33,33,300/-. The Andhra Pradesh Civil Courts Act, 1972 stipulates that appeals with a valuation below Rs. 50 lakhs are to be filed in the District Court, not the High Court.


The appellant's counsel argued that the valuation should consider the total market value of the property, claimed to be Rs. 66,66,600/-, thus justifying the High Court's jurisdiction. However, the court held firm that the valuation for court fee purposes, Rs. 33,33,300/-, must also dictate jurisdiction, in line with the Full Bench decision in Kalla Yadagiri v. Kotha Bal Reddy, and supported by the Supreme Court's precedent in S. RM. AR. S. SP. Sathappa Chettiar v. S. RM. AR. RM. Ramanathan Chettiar.


The court concluded that the appeal was improperly filed and should be redirected to the Principal District Judge. This judgment underscores the necessity for litigants to adhere strictly to statutory provisions when determining the jurisdiction of appeals.
