In a landmark ruling, the Andhra Pradesh High Court, presided over by Justice Nyapathy Vijay, has directed the expeditious conclusion of disciplinary proceedings against government employees, underscoring their significant impact on the employees' careers and fundamental rights. The judgment, delivered on February 11, 2026, addresses a writ petition filed by G. Ravi Kumar, challenging the prolonged disciplinary proceedings initiated against him.


The court highlighted the detrimental effects of delayed disciplinary proceedings, which affect employees' career prospects, mental well-being, and retirement benefits. Such delays, the court noted, infringe upon the right to lead a dignified life as guaranteed under Article 21 of the Indian Constitution.


Justice Vijay emphasized the dual right of employees and the department to have disciplinary proceedings concluded expeditiously. This is not only to ensure justice for employees but also to inspire public confidence and promote integrity within government departments.


The court adopted the mechanism of continuing mandamus, a judicial procedure designed to continuously monitor and ensure compliance with court orders, directing the government to adhere to the time limits prescribed in G.O.Ms.No.679 (2008) and G.O.Ms.No.91 (2022). This approach aims to mitigate administrative lapses and overcome bureaucratic inertia.


An affidavit from the Chief Secretary of Andhra Pradesh revealed that numerous disciplinary proceedings remain pending due to various administrative hurdles, including changes in employee lists, non-capture of data, and file unavailability. With 5,424 disciplinary cases pending, the court recognized the substantial judicial impact and the mental distress caused to employees awaiting resolution.


The court ordered the respondent, the State Government, to file periodic affidavits every four months, updating the court on the progress of disciplinary proceedings until the majority are concluded. This measure ensures ongoing oversight and accountability, reflecting the court's commitment to safeguarding employees' rights and maintaining public trust in the administration.


This decision is expected to expedite the resolution of pending cases, offering relief to affected employees while reinforcing the importance of timely justice.
