Special Court's Failure to Follow Legal Procedures Under NDPS Act Leads to Reconsideration of Confiscation
In a significant ruling, the Andhra Pradesh High Court has set aside the confiscation order of a Tata Sumo vehicle used in the transportation of narcotic substances due to procedural lapses by the Special Court. The case, titled "Neerudi Dhanamma v. State of Andhra Pradesh," was adjudicated by Justice B.V.L.N. Chakravarthi, who highlighted the failure of the Special Court to adhere to the mandatory procedures outlined in Sections 60 and 63 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act).
The appeal was filed by Neerudi Dhanamma, the owner of the confiscated vehicle, who argued that the vehicle was used without her knowledge or involvement in the illegal transportation of narcotic substances. The appellant's counsel emphasized that the Special Court did not issue a notice or provide an opportunity for the appellant to present her case, violating the procedural safeguards under the NDPS Act.
The High Court noted that the Special Court's decision dated December 8, 2008, did not document compliance with the requisite procedures. The judgment mentioned that the vehicle was ordered to be sold and the proceeds confiscated without a proper inquiry or opportunity for the vehicle owner to contest the allegations.
Justice Chakravarthi underscored the importance of following due process, stating that the NDPS Act mandates a fair hearing and consideration of evidence before confiscating property. The judgment remanded the case back to the Special Court for a fresh decision, instructing it to adhere to the legal procedures and provide opportunities to both the appellant and the State to present their arguments.
The High Court directed the Special Court to expedite the reconsideration process, given the protracted timeline since the original case in 2008. The case highlights the judiciary's commitment to ensuring procedural justice and the protection of individual rights, even in the context of stringent narcotics laws.
Bottom line:-
The procedure contemplated under Sections 60 and 63 of the Narcotic Drugs and Psychotropic Substances Act, 1985 must be followed before passing an order of confiscation of a vehicle used for transporting narcotic substances.
Statutory provision(s): Narcotic Drugs and Psychotropic Substances Act, 1985 Sections 60(3), 63, and 36-C; Code of Criminal Procedure, 1973 Section 452, 405.
