Court Upholds Tribunal's Decision, Declares Government Order Arbitrary and Discriminatory Against Assistant Engineers


In a landmark decision, the Andhra Pradesh High Court has upheld the judgment of the Andhra Pradesh Administrative Tribunal, striking down the imposition of additional seniority conditions for promotions to the post of Deputy Executive Engineer under the Andhra Pradesh Roads and Buildings Engineering Service Rules. The judgment was delivered by a bench comprising Justices R Raghunandan Rao and T.C.D. Sekhar, in response to writ petitions challenging the validity of G.O.Ms.No.82, dated February 25, 2009.


The controversy stemmed from the government's decision to impose seniority conditions that affected the promotional avenues of Assistant Engineers, classified under a 24-point roster system established by G.O.Ms.No.103. The roster system had initially reserved specific vacancies for Assistant Engineers, Assistant Executive Engineers, and Draughtsmen. However, the additional seniority condition introduced by G.O.Ms.No.82 was perceived as arbitrary, as it allowed for the supersession of Assistant Engineers by Assistant Executive Engineers, thereby disrupting the established roster system.


Assistant Engineers argued that the additional seniority condition discriminated against them by undermining their promotional opportunities, as it did not allow for a carry-forward mechanism within the roster system. The Tribunal had previously ruled in favor of the Assistant Engineers, setting aside the contested government order. The High Court's decision to dismiss the writ petitions filed by the Assistant Executive Engineers seeking to reinstate the seniority condition reaffirms the Tribunal's stance on the issue.


The petitioners, represented by Senior Counsel Sri. M. Vijaya Kumar, contended that the seniority condition was necessary to preserve the promotional hierarchy and prevent diploma-holding Assistant Engineers from being promoted over degree-holding Assistant Executive Engineers. However, the High Court found that the imposition of such a condition, without a carry-forward mechanism, led to arbitrariness, effectively nullifying the promotional chances of Assistant Engineers within the roster system.


The judgment emphasized the importance of maintaining equitable promotional conditions across different feeder categories and noted that educational qualifications, while a valid basis for classification, could not justify the arbitrary imposition of seniority conditions that disadvantage one group over another.


The decision marks a significant victory for Assistant Engineers, who had contended that the government's move was discriminatory and lacked a rational nexus to the established promotion system. The court's ruling ensures that promotions will proceed in accordance with the original roster system, without the imposition of additional seniority conditions.
