Court Rules Preferences at Application Stage Cannot Override Merit in Teacher Appointments


In a significant ruling, the Andhra Pradesh High Court has emphasized the importance of merit-based recruitment, ruling that preferences indicated at the application stage cannot supersede merit when appointing teachers. The judgment, delivered by Justice Nyapathy Vijay, addressed issues related to the recruitment process for School Assistants (SA) and Secondary Grade Teachers (SGT) under the Andhra Pradesh Teacher Recruitment Test (AP TRT) Rules, 2025.


The case arose from writ petitions filed by Kamireddy Bhavani and others, who challenged the recruitment process that considered their preferences for secondary-grade teacher positions over their merit, despite qualifying for higher positions as School Assistants. The court found that the recruitment notification, which required candidates to list preferences at the application stage, could not justify appointments that ignored merit.


Justice Nyapathy Vijay highlighted that Rule 10 of the recruitment guidelines, which mandated the submission of preferences, conflicted with Rule 3, which prioritized merit-cum-roster for selections. The court ruled that merit should be the primary consideration, aligning with Articles 14 and 16 of the Constitution, which advocate for equality in public employment.


The court's decision mandates the respondents to reconsider the petitioners' appointments as School Assistants based on their merit rankings, overriding the initial preferences indicated at the application stage. This judgment reinforces the principle that recruitment processes must prioritize the selection of the most qualified candidates to ensure quality education and uphold constitutional values.
