Court Directs Applicant to Surrender and File Regular Bail; Emphasizes Compliance with Legal Procedures


In a significant development, the Madhya Pradesh High Court at Jabalpur, presided over by Justice Avanindra Kumar Singh, addressed the anticipatory bail plea filed by Samarth Singh in connection with a criminal case registered under the Bharatiya Nagarik Suraksha Sanhita, 2023. The matter, titled "Samarth Singh v. State of Madhya Pradesh," involved charges under Sections 80(2), 85, and 3(5) of the new legislative framework. 


The case, registered as Misc. Criminal Case No. 24352 of 2026, was heard on May 22, 2026. During the proceedings, the applicant, represented by Senior Advocate Mrigendra Singh, sought to withdraw the anticipatory bail application with the liberty to surrender before the trial court or the Investigating Officer. The request also included a plea for the trial court to dispose of the regular bail application on the same day.


The Solicitor General of India, Shri Tushar Mehta, alongside the Advocate General for the State, Shri Prashant Singh, opposed the withdrawal and the accompanying request. However, after deliberating on the matter, Justice Avanindra Kumar Singh emphasized the procedural correctness in such cases, suggesting that the accused, fearing police torture, should either surrender before the trial court or the Investigating Officer.


The court directed that if the applicant surrenders to the Investigating Officer, a formal arrest should be conducted in accordance with the law, with the accused being produced before a competent court within 24 hours. Alternatively, if the surrender occurs before the trial court, the court is tasked with notifying the Station House Officer, who must present the case diary and make the necessary applications.


The court's decision underscores the importance of adhering to established legal procedures, ensuring that the rights of the accused are protected while enabling the police to perform their duties within the framework of the law. The order, which allows the withdrawal of the anticipatory bail application, grants the applicant the liberty to pursue a regular bail application, with the trial court expected to expedite the process.


The judgment reflects the court's commitment to balancing the rights of individuals against the responsibilities of law enforcement agencies, emphasizing the need for procedural integrity in criminal proceedings.
