Bombay High Court Directs Immediate Security Overhaul for Maharashtra Courts

Court Orders Deployment of Additional Security Personnel Across State, Sets February Deadline for Initial Implementation

The Bombay High Court, Aurangabad Bench, has mandated immediate action to enhance security across court premises in Maharashtra. In a directive issued on February 5, 2026, the court emphasized the urgent need for deploying additional security personnel, particularly at the Principal Seat and various benches of the Bombay High Court.

The judgment came in response to a Criminal Suo-Moto Public Interest Litigation filed by Amicus Curiae against the Union of India and others. The court highlighted the necessity to deploy 381 security personnel promptly, with clear instructions to the Registrar General to finalize contracts and ensure deployment by the end of February 2026.

The court laid out a three-stage implementation plan, backed by a substantial budget allocation of Rs. 443,24,84,560, aimed at deploying a total of 8,282 security personnel across the state. The first stage focuses on the High Court, followed by district and taluka courts.

In its detailed assessment, the court noted a current deficit of 214 personnel at the Aurangabad Bench, underscoring the critical need for additional support from the Maharashtra State Security Corporation. The judgment also calls for affidavits on compliance and future security plans to be filed within two weeks, with further deliberations scheduled for February 23, 2026.

The court's directive follows a prior government resolution and ensures that funds already allocated are utilized within the current financial year. The court has urged the state government to uphold its commitment to security enhancements and to provide a statement on oath regarding future implementation stages.

Bottom Line:

Directions issued for deployment of security personnel across court premises in Maharashtra, with emphasis on immediate compliance and phased implementation for enhanced security measures.

Statutory provision(s): Security Arrangements for Courts.
