 In a significant judgment, the Bombay High Court has directed the State to resolve a complaint concerning the alleged illegal collection of fees by the ILS Law College within two months. The decision comes in response to a writ petition filed by Mayur Suhas Garud, who claimed that the college unlawfully collected a total of Rs.1,04,863 over several academic years. The court's directive includes a mandate for the State to communicate the resolution to the petitioner within a week of the decision.


The petition, filed under Writ Petition No. 11546 of 2025, sought judicial intervention for the refund of fees with interest, allegedly collected without due authority. The petitioner had previously lodged a complaint with the State on April 11, 2025, which remains unresolved.


During the court proceedings, the Additional Government Pleader (AGP) representing the State affirmed that the complaint will be addressed within the specified timeframe. Additionally, legal representatives for the college declared that no action would be taken concerning a show-cause notice issued to the petitioner on March 24, 2025, acknowledging the college's commitment to refrain from further action.


The bench, comprising Justices R.I. Chagla and Advait M. Sethna, acknowledged these assurances and consequently disposed of the petition, ensuring the rights and contentions of the involved parties remain intact. The court clarified that it did not delve into the merits of the case, thereby keeping future legal avenues open for both parties.


This judgment underscores the judiciary's role in addressing grievances related to educational institutions while ensuring due process and accountability from state authorities.
