The court restrained the dissemination of disparaging advertisements that allegedly denigrate Asian Paints' product, "Apcolite Shyne All Protek," through social media platforms such as WhatsApp and Instagram.


Presided by Justice Arif Doctor, the court found a prima facie case of disparagement, emphasizing the malicious intent behind the advertisements comparing Asian Paints' product with Berger Easy Clean, a product of Defendant No. 3. The advertisements portrayed Asian Paints' product as inferior, ineffective, and falsely advertised, with statements like "competition paint that claims stain resistance, but is actually just washable" and "the truth is visible. The colour marks stay. The stain stays."


The court's decision was based on the clandestine nature of the advertisement's dissemination and its potential to cause irreversible damage to Asian Paints' goodwill and reputation. The court noted that the advertisements not only extolled the virtues of the Defendant's product but also denigrated the Plaintiff's product, which is against the permissible limits of comparative advertising.


The judgment underscores the importance of truthful and fair advertising practices, as well as the legal protections against disparagement and slander of goods. The court's decision serves as a precedent for similar cases, reinforcing the need for businesses to maintain ethical standards in their advertising campaigns.
