Court Upholds Legal Heirs' Entitlement Despite Deceased Employee's Nomination Switch Amidst Matrimonial Discord


In a significant ruling, the Bombay High Court has directed the State of Maharashtra to provide family pension benefits to Vaishali, the widow of a deceased government employee, and her sons under the Maharashtra Civil Services (Pension) Rules, 1982 (MCSR 1982). This decision comes despite the deceased employee's previous decision to nominate his brother as a beneficiary, replacing his wife amidst ongoing divorce proceedings.


The case, heard by Justices Manish Pitale and Y. G. Khobragade at the Aurangabad Bench, revolved around the interpretation of several Government Resolutions and Circulars concerning pension entitlements for state employees. The deceased employee, who passed away before completing ten years of service, had initially nominated his wife and sons as beneficiaries but later amended the nomination to include his brother instead of his wife due to marital discord.


The court ruled the nomination under MCSR 1982 invalid because the deceased was governed by the Defined Contributory Pension Scheme (DCPS), which does not provide for a family pension. Instead, the court held that the petitioners, being legal heirs, are entitled to family pension benefits as outlined in the Government Resolution dated 31st March 2023. This resolution allows family pensions for employees who died between 1st November 2005 and 31st March 2023, aligning with a broader policy shift to extend pension benefits to families under the MCSR 1982.


The court also addressed allegations of adultery against the widow, stating that such claims do not disqualify her from receiving family pension unless a judicial separation on those grounds is granted. Consequently, the court ordered the State to release the family pension benefits and arrears to the petitioners within eight weeks, with provisions for interest in case of delay.


This judgment underscores the court's commitment to interpreting pension policies in favor of legal heirs, ensuring they receive due benefits despite procedural and personal disputes.
