Court Overrules Cutoff Date in Government Resolution to Uphold Justice and Fairness for Public Servants' Families


In a significant judgment, the Bombay High Court, Circuit Bench at Kolhapur, has ruled in favor of the petitioners in the case of Smt. Sanika Santosh Shinde and others versus the State of Maharashtra. The court granted relief to the legal heirs of Santosh Vishnu Shinde, a government employee who succumbed to COVID-19 after performing his official duties. The bench comprised Justice Madhav J. Jamdar and Justice Pravin S. Patil.


The petitioners, represented by Mr. Tejpal Ingale, sought benefits under the Government Resolution dated 29th May 2020, which provided ex-gratia compensation to government employees who contracted COVID-19 while on duty. Despite Mr. Shinde's death occurring on 3rd July 2021, past the cutoff date of 30th June 2021 specified in a later resolution, the court found that the original criteria allowing benefits to employees on duty 14 days before hospitalization or death should prevail.


The court observed that the cutoff date in the subsequent resolution should not override the intent of the original resolution, which aimed to support families of employees who risked their lives during the pandemic. The judgment emphasized that denying benefits based on a strict interpretation of the cutoff date would contravene principles of justice, fairness, and societal gratitude.


Citing a precedent in the case of Vijaya Yashwant Jadhav v. Block Development Officer, the court underscored the importance of extending benefits beyond mere symbolic gestures, recognizing the sacrifices made by public servants and sending a message of societal value placed on self-sacrifice.


The court directed the State of Maharashtra to quash the impugned communication denying the ex-gratia benefit and ordered that the petitioners be paid Rs. 50 lakh within six weeks. This decision is seen as a testament to the judiciary's role in upholding constitutional values and ensuring justice for the families of those who served the nation during the pandemic.


Bottom Line:

Government employees who succumbed to COVID-19 after performing official duties are entitled to benefit under relevant Government Resolutions even if the death occurred after the cutoff date specified in the Resolutions.
