Court Issues Guidelines to Prevent Delays in Shalarth Pranali Inclusion Affecting Teacher Remuneration


In a significant ruling, the Bombay High Court has directed the timely processing of proposals related to the inclusion of teachers' names in the Shalarth Pranali, a system crucial for the disbursement of salaries to educators working in aided institutions across Maharashtra. The court's decision came in response to a writ petition filed by Vijay, an Assistant Teacher, who faced a prolonged delay in receiving his salary due to administrative inaction.


The court heard the petition under Article 226 of the Constitution of India, where the petitioner sought a directive against the Divisional Deputy Director of Education, Chhatrapati Sambhajinagar, for the inclusion of his name in the Shalarth Pranali, allowing for his salary disbursement. Despite having all necessary approvals for his appointment, Vijay's proposal for inclusion in the salary disbursement system remained pending for an extended period, depriving him of his lawful remuneration.


In its judgment, the bench comprising Justices Vibha Kankanwadi and Hiten S. Venegavkar expressed concern over the administrative delays affecting teachers' livelihoods. The court highlighted that salary is a lawful entitlement, not a charity, and any delay in salary payments significantly impacts the dignity and financial stability of teachers.


The court criticized the lack of a structured timeline for processing such proposals, which often leads to arbitrary delays. To address this, the court issued comprehensive guidelines aimed at ensuring efficient and timely decision-making by Education Officers and Divisional Deputy Directors of Education. The court mandated that proposals must be scrutinized and processed within specified time frames, with any deficiencies communicated promptly to avoid unnecessary delays.


The guidelines require Education Officers to scrutinize proposals within fifteen days of receipt, and any deficiencies must be communicated to the management within the same period. The management is then given a reasonable period to rectify these deficiencies. Once corrected, the proposal must be decided within thirty days. In cases requiring forwarding to the Divisional Deputy Director of Education, the proposal should be sent within seven days with clear recommendations.


The court further directed the Principal Secretary of the School Education Department to issue a Government Resolution incorporating these guidelines within two months. The resolution is to be circulated to all relevant authorities, ensuring adherence to the timelines and procedures for processing teacher-related proposals.


The ruling underscores the need for accountability and transparency in the administrative processes affecting teachers' remuneration. By mandating strict adherence to timelines, the court aims to eliminate undue delays and ensure that teachers receive their rightful dues promptly.
