Bombay High Court Orders Re-evaluation of Compensation Claim by Railway Claims Tribunal

In a significant ruling, the Bombay High Court has overturned a previous decision by the Railway Claims Tribunal, which had rejected a compensation claim filed by the family of a deceased railway passenger. The case, titled "Rekha Rupchand Singh (Deleted) v. Union of India," was presided over by Justice Jitendra Jain.


The original claim was dismissed by the Railway Claims Tribunal on the grounds of discrepancies in the name on the Railway Identity Card and monthly season ticket, as well as the lack of proof of relationship between the deceased and the claimants. The Tribunal had concluded that these discrepancies were sufficient grounds to deny compensation.


However, Justice Jain found the Tribunal's reasoning flawed. He pointed out that the identity card number was consistent across both the Railway Identity Card and the monthly season ticket, conclusively establishing that the ticket was issued to the same individual. The court held that the non-punching of the full name by the ticket counter officer should not penalize the claimants. This aligns with a precedent set by the Allahabad High Court in the case of Union of India v. Smt. Sunita Devi, where it was ruled that identity should be established through available evidence, and technical discrepancies should not negate a compensation claim.


Furthermore, the High Court criticized the Tribunal for not adequately considering the documents submitted to prove the relationship between the deceased and the claimants. The appellants had presented various documents, including the Election Card and school leaving certificates, which the Tribunal had overlooked. Justice Jain emphasized the importance of these documents and directed that the case be remanded back to the Tribunal for re-adjudication on the relationship issue.


The High Court has instructed the claimants to appear before the Tribunal on April 6, 2026, with the current order. The Tribunal is directed to reassess the relationship between the claimants and the deceased, taking into account all submitted evidence. If the relationship is proven, the Tribunal is to pass appropriate orders for compensation.


This judgment underscores the judiciary's role in ensuring that technical discrepancies do not prevent rightful claims, particularly in cases involving compensation for untoward incidents. The decision mandates that all relevant documentation be considered thoroughly to establish eligibility for compensation.
