Evidence of Conversion to Christianity Found Insufficient; Validity Certificate Directed to be Issued to Petitioner


In a significant ruling, the Bombay High Court, Nagpur Bench, quashed the decision of the District Caste Certificate Verification Committee, Akola, which had invalidated the caste claim of Stavan Wilson Sathe to the Scheduled Caste "Mang". The court found that the Committee's reliance on inadequate evidence of conversion to Christianity was insufficient to deny the petitioner his Scheduled Caste status.


The petitioner, Stavan Wilson Sathe, challenged the Committee's order dated 27th September 2023, which rejected his claim based on alleged conversion of his forefathers to Christianity. The Committee had cited the presence of Christian names in his family tree and entries in school records as evidence of conversion. However, the High Court, led by Justices M. S. Jawalkar and Nandesh S. Deshpande, found that these factors were irrelevant and not supported by concrete evidence such as baptism records.


The court emphasized that the mere presence of religious symbols or names was inadequate to prove conversion. It highlighted the lack of any baptism or formal acceptance into the Christian community. The court also noted historical documents dating back to 1932, which consistently identified the petitioner’s forefathers as belonging to the "Mang" caste.


In its judgment, the court pointed out that the onus was on the Caste Scrutiny Committee to thoroughly verify claims before rejecting them. The Committee's reliance on irrelevant factors and its failure to conduct a proper inquiry rendered its decision erroneous. The court directed the Committee to issue a validity certificate to the petitioner within two months, confirming his Scheduled Caste status.


This ruling reinforces the principle that caste claims must be evaluated based on substantial evidence, and conversion claims require concrete proof. The judgment is expected to have significant implications for similar cases where caste claims are contested based on alleged religious conversions.
