Formation of High Power Committee to Enforce Pollution Control and Mitigation Strategies


The Bombay High Court has taken significant steps to address the escalating air pollution levels in Mumbai and its surrounding areas by initiating a suo motu Public Interest Litigation. Concerned by the severe air quality issues reported in the city, the court has constituted a High Power Committee (HPC) to monitor, supervise, and recommend measures for pollution control across the Mumbai Metropolitan Region.


Following a news article highlighting the adverse health impacts of air pollution, particularly on vulnerable groups, the court intervened to mitigate the pollution crisis. On November 6, 2023, the court reviewed affidavits and suggestions from various stakeholders, including NGOs and senior advocates, leading to comprehensive directives for the implementation of the Mumbai Air Pollution Mitigation Plan.


The directives include making Assistant Municipal Commissioners personally liable for lapses in implementing the plan and ensuring compliance with dust control measures at construction sites. The court has ordered the installation of air quality monitors and mandated transportation of construction materials in covered vehicles. In addition, municipal authorities are tasked with spreading public awareness about pollution and enforcing guidelines on vehicular emissions and firecracker usage.


Expressing dissatisfaction with the efforts of municipal corporations and the Maharashtra Pollution Control Board, the court emphasized the need for more stringent measures. This led to the formation of multiple committees, including a reconstituted committee comprising environmental experts and former administrative officers, to oversee daily pollution control activities.


The court's proactive stance has resulted in the establishment of a High Power Committee, comprising former judges and experts, to ensure compliance with court orders and recommend strategies for immediate, medium-term, and long-term pollution control. This committee will work closely with municipal bodies, submitting reports and recommendations to the court regularly.


The court's judgment highlights the failure of authorities to adequately address the pollution crisis, urging them to take more effective actions. The decision marks a pivotal moment in Mumbai's environmental governance, aiming to safeguard public health and enhance air quality in the region.
