Court Grants Injunction to Protect Glenmark's Medicinal Trademark, Orders Costs Against Zenlabs for Trademark Infringement and Passing Off


In a significant judgment, the Bombay High Court has ruled in favor of Glenmark Pharmaceuticals Limited in a trademark infringement and passing off suit against Zenlabs India. The court, presided over by Justice Arif S. Doctor, found that Zenlabs' use of the trademark 'ZENOX' was deceptively similar to Glenmark’s registered trademark 'ZINOX', both visually and phonetically. This ruling is pivotal in the pharmaceutical sector where product confusion could lead to life-threatening consequences.


The suit, filed by Glenmark, claimed that Zenlabs' mark 'ZENOX' was nearly identical to their 'ZINOX' mark, which could mislead consumers into purchasing Zenlabs' products, thinking they were buying Glenmark’s. Glenmark had adopted the 'ZINOX' trademark in 2007 for their medicinal products used to treat bacterial infections and had been using it extensively, garnering substantial goodwill.


Despite being served, Zenlabs did not file a defense, leading the court to treat the suit as undefended. Glenmark presented evidence including sales turnover statements and promotional expenses, substantiating the use and reputation of their trademark. The court held that the similarity of the marks and the identical nature of the products increased the risk of consumer confusion, which is especially crucial in the pharmaceutical industry.


The court cited precedents, emphasizing the need for stringent measures against deceptive similarity in medicinal products due to potential health risks. It held that Zenlabs’ adoption of the 'ZENOX' mark was dishonest and aimed at capitalizing on Glenmark’s established goodwill.


Justice Doctor decreed the suit in favor of Glenmark, granting an injunction against Zenlabs to prevent them from using the 'ZENOX' mark. Additionally, the court ordered Zenlabs to pay costs amounting to Rs. 5,00,000 to Glenmark, emphasizing that the defendants' conduct warranted such an order.


This judgment underscores the importance of protecting trademark rights, particularly in the pharmaceutical industry, to ensure public safety and uphold the integrity of established brands.
