Father’s Unemployment Not a Valid Reason to Avoid Legal Responsibility, Rules High Court
In a significant ruling, the Bombay High Court's Nagpur Bench has reinforced the legal obligation of fathers to provide maintenance for their minor children, irrespective of financial difficulties or unemployment. The judgment was delivered by Justice M.M. Nerlikar in the case of Shaikh Afsar Shaikh Akbar versus Ayesha Parvin Abdul Gafur, addressing the challenge against a Family Court order which granted maintenance to the applicant’s minor children.
The case revolved around the applicant, Shaikh Afsar Shaikh Akbar, who contested a Family Court decision that mandated him to pay Rs. 4,000 monthly to each of his minor children aged 10 and 7. The applicant argued financial incapacity due to unemployment and prior payments made under "Khulanama" - an agreement wherein Rs. 2,75,000 was paid as "Mehar" to dissolve the marriage with non-applicant No.1, Ayesha Parvin Abdul Gafur. Despite these claims, the High Court underscored the father's inherent obligation to maintain his children, highlighting the personal, legal, and absolute nature of this responsibility.
Justice Nerlikar, referring to precedents set by the Karnataka High Court in Sri Sunil v. Nimnish, emphasized that financial hardships do not exempt a father from his duty to support his offspring. The Court reiterated that the parent-child relationship inherently demands maintenance, and factors such as unemployment cannot be used as an excuse for neglecting this duty.
The applicant's request to reduce the maintenance amount to Rs. 3,000 as per the initial agreement was also dismissed. The High Court found no merit in the argument that the Family Court's decision was excessive or erroneous, affirming that the discretion exercised by the Family Court was appropriate and should not be interfered with.
The judgment marks a critical reaffirmation of legal principles concerning parental obligations, stressing that the welfare of minor children takes precedence over financial excuses. The case serves as a reminder of the unwavering legal standards governing family maintenance, where personal circumstances do not negate established duties.
