In a significant ruling, the Bombay High Court clarifies the application of seniority provisions under the Persons with Disabilities Act, 1995.


Nagpur, March 26, 2026 – The Nagpur Bench of the Bombay High Court, presided over by Justice M. W. Chandwani, has delivered a crucial judgment concerning the seniority rights of employees who acquire a disability during service and are subsequently absorbed into a new post. The judgment addresses the interpretation of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, particularly in relation to maintaining seniority within the new cadre.


The case involved petitioner Rameshwar, a former Lab Technician with the Zilla Parishad, Yavatmal, who incurred a disability in 2010. Following his disability, he was absorbed into the role of Extension Officer (Panchayat) in 2016, pursuant to a directive from the High Court. The crux of the issue was whether his seniority should be based on his initial appointment date or his absorption date in the new cadre.


Despite the petitioner’s contention that his initial appointment date should determine his seniority, the Court held that absorbing a disabled employee into a new cadre should not disrupt the seniority of existing employees within that cadre. The judgment emphasized that the legislative intent of Section 47 is to protect the employment and service benefits of disabled employees without adversely impacting the rights of other employees.


Justice Chandwani noted that while Section 47(1) of the Act prohibits demotion or dismissal due to disability, it does not mandate seniority adjustment to the detriment of other employees. The Court further clarified that promotion cannot be denied solely on the grounds of disability, provided the employee meets the requisite criteria for promotion, which in this case, the petitioner did not satisfy.


The Court dismissed the petition, concluding that the petitioner’s seniority in the new cadre should be determined from the date of his absorption, not his initial appointment. The judgment underscores the balance between protecting the rights of disabled employees and maintaining fairness and order within organizational structures.


This ruling sets a precedent for similar cases, highlighting the nuanced application of the Persons with Disabilities Act in protecting employment rights without undermining the established seniority systems within organizations.
