In a significant development, the Calcutta High Court has directed the West Bengal Regional School Service Commission, Southern Region, to expedite the appointment of Jalil Iqbal as an Assistant Teacher in an Urdu medium school under the die-in-harness category. This directive came after Jalil Iqbal, who had been empanelled in 2002, faced an interminable delay in securing his position despite fulfilling all requisite conditions.


Presided over by Justice Ajay Kumar Gupta, the court emphasized the urgency of the matter given the prolonged pendency since 2010. The petitioner, represented by Advocates Mr. Prahlad Chandra Ghosh and Mr. Subir Hazra, had petitioned the court to issue a mandate for his appointment, citing the persistent inaction from the respondent authorities.


The case, registered under WPA 5940 of 2010, saw Jalil Iqbal enlisted for appointment in the Urdu (Hons.)/Hindi Medium/General category based on a recommendation from the District Inspector of Schools in 2002. Despite being empanelled, the petitioner faced delays due to alleged non-availability of posts, a claim contested by his counsel.


With the court now directing the respondent authority to act within six weeks, the resolution of this case promises relief to Jalil Iqbal, who has been caught in bureaucratic limbo for over a decade. This order also requires Jalil Iqbal to communicate the directive alongside the writ petition to the concerned authorities to ensure compliance.


Justice Gupta underscored the importance of adhering to lawful procedures in executing this appointment, noting the petitioner’s prolonged wait and the lack of representation from the respondent authorities during the proceedings.


The judgment not only marks a potential end to Jalil Iqbal's wait but also serves as a reminder to administrative bodies about the necessity of timely and efficient action in cases of compassionate appointments.
