Calcutta High Court Disposes Petition on Protection of Political Confidential Data

Court Affirms No Seizure or Data Backup During Enforcement Directorate's Search, Petition Concluded Without Further Action

In a significant ruling, the Calcutta High Court has disposed of a writ petition filed by the All India Trinamool Congress seeking the preservation and protection of its political confidential data. The petition raised concerns over potential unauthorized circulation or divulgence of sensitive political data following a search conducted by authorities. The court, presided over by Justice Suvra Ghosh, concluded the matter after receiving submissions from the respondents, affirming that no seizure or data backup occurred during the search.

The All India Trinamool Congress had approached the court, urging for the protection of its political confidential data. The primary concern was to ensure that such data was not circulated or divulged without authorization, particularly by the 2nd and 3rd respondents involved in the search operation conducted on January 8, 2026.

During the proceedings, the respondents, represented by learned counsels, submitted that no data was seized or backed up from the two premises in question. This submission was supported by the presentation of panchanamas drawn up by the Enforcement Directorate, which documented that no items were seized from either the office of the pro-forma respondent or the residence of the company's Director.

Justice Suvra Ghosh, upon considering the submissions and evidence presented, concluded that no further action was required in the matter. The writ petition was thus disposed of. The court noted that since no affidavit was invited, the allegations contained in the writ petition were deemed not admitted.

The ruling comes as a relief to the All India Trinamool Congress, ensuring that its political confidential data remains protected. The court's decision also underscores the importance of maintaining transparency and accountability during search operations conducted by authorities.

The judgment, while dismissing the petition, did not impose any order as to costs, and the parties were informed that they could obtain an urgent certified copy of the order upon fulfilling requisite formalities.

Bottom Line:

Protection of political confidential data - Petition seeking preservation of political confidential data and protection from unauthorized circulation or divulgence - Submissions by respondents that no seizure or data backup was taken during the search - Petition disposed of in view of such submissions.
