Calcutta High Court Grants Bail in Cannabis Cultivation Case

Bail Granted to Augustine Ballava with Conditions to Prevent Misuse and Ensure Trial Attendance


In a significant legal development, the Calcutta High Court's Circuit Bench at Port Blair has granted bail to Augustine Ballava, a 52-year-old cultivator, who was arrested for cultivating cannabis plants in his backyard. The judgment, pronounced by Justice Sabyasachi Bhattacharyya on April 27, 2026, highlights crucial aspects of the Narcotic Drugs and Psychotropic Substances Act, 1985, particularly the application of Section 37.


The petitioner, Augustine Ballava, faced allegations of cultivating cannabis plants and possessing sealed packets of cannabis branches found in his bathroom. The prosecution opposed bail, arguing that the severity of the offense could lead to the distribution of cannabis, affecting the younger generation.


However, the court observed that the rigours of Section 37(1)(b) of the NDPS Act, which imposes strict conditions for bail, do not apply to offenses under Section 20(a) as they do not involve commercial quantities. The judgment noted the absence of commercial quantity in the statute concerning cannabis plant recovery, thus negating the applicability of Section 37(1)(b) in this case.


Justice Bhattacharyya, in his judgment, also addressed the irrelevant grounds of arrest related to misappropriation of public funds, which were not corroborated by the FIR narrative. Consequently, such grounds could not influence the bail decision.


The court granted bail to Ballava under stringent conditions to prevent misuse and ensure his presence during the trial. These conditions include furnishing a bond of Rs.10,000 with two sureties and prohibiting entry into the jurisdiction of PS Kalighat, where the alleged offense occurred. Ballava must also report weekly to PS Rangat and attend the trial on designated dates.


This judgment underscores the importance of applying legal provisions accurately and highlights the judiciary's role in balancing the seriousness of allegations with the rights of the accused.


Bottom line:-

NDPS Act - Rigours of Section 37 of NDPS Act do not apply to offences under Section 20(a) as it does not involve commercial quantity of Cannabis plants. Bail granted with conditions to prevent misuse and ensure attendance at trial.
