In a significant ruling, the Calcutta High Court has directed the cancellation of an Other Backward Classes (OBC) certificate obtained fraudulently by a candidate who contested the Panchayat elections under reserved category. The court was addressing two writ petitions: WPA No. 21813 of 2025 filed by Ranajit Rakshit, seeking the cancellation of the OBC certificate of the private respondent, and WPA No. 20033 of 2025 by the respondent challenging the Sub-Divisional Officer's findings that the certificate was fraudulently obtained.


The crux of the case revolved around the misuse of an OBC certificate by the private respondent, who was elected as Pradhan of the Iswarpur Gram Panchayat. The Sub-Divisional Officer, upon re-evaluation as directed by the court, concluded that the respondent did not belong to the OBC community, specifically the "Tanti, Tantubaya" sub-caste, thus rendering the certificate invalid.


The court emphasized the role of the Sub-Divisional Officer in ensuring that corrective measures are taken when fraudulent means are identified in obtaining such certificates. Despite the officer's findings, no immediate action was taken to cancel the certificate, prompting the High Court's intervention.


The judgment also highlighted the legal consequences of using a fraudulent certificate, noting that it constitutes a violation of constitutional principles and statutory mandates concerning reservations.
