Court Overturns Controller's Decision, Cites GUI's Visual Features as Qualifying for Design Status


In a significant ruling, the Calcutta High Court has clarified the eligibility of Graphic User Interfaces (GUIs) for registration under the Designs Act, 2000. The judgment, delivered by Justice Ravi Krishan Kapur, addressed a series of appeals filed by NEC Corporation and others against the Controller of Patents and Designs. The court set aside previous decisions by the Controller that had rejected the registration of GUIs, asserting that GUIs inherently possess the visual features necessary to qualify as designs.


The court examined the definitions of "article" and "design" under Sections 2(a) and 2(d) of the Designs Act, determining that GUIs meet the criteria laid out for design registration. Justice Kapur emphasized that GUIs, with their iconography, layout, color schemes, and ornamentation, fall within the visual features contemplated by the Act. The judgment also rejected the argument that GUIs need to be permanently visible or tactile to qualify as designs.


The court criticized the Controller's narrow interpretation of the terms "article" and "design," which excluded digital and virtual forms such as GUIs. It highlighted the importance of an updating construction approach, acknowledging technological advancements and aligning with international practices.


The ruling noted that GUIs are a critical asset in modern technology and commerce, and their registration under design laws is crucial for legal certainty and innovation protection. The decision aligns India with global standards, as most jurisdictions already recognize GUIs under design laws.


The court has remanded the cases for rehearing, instructing the Controller to apply the correct legal tests in determining design registration for GUIs. This decision is a landmark step towards embracing digital designs within India's intellectual property framework.
